Terms of Service

1. Acceptance of Terms
By accessing or using Flash Flamingo (the "Service"), operated by Marcin Szamatowicz (NIP: 1133126261, REGON: 527928004), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. The Service
Flash Flamingo provides an AI-powered fashion photography platform that allows users to upload product images and generate synthetic fashion model photography. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
3. Accounts and Subscriptions
Registration
You must provide accurate and complete information when creating an account.
Payments
Payments are processed via Paddle, our Merchant of Record. By subscribing, you agree to Paddle's terms and conditions.
Billing
Subscriptions automatically renew unless cancelled through your account settings or by contacting Paddle support.
Tokens
If the Service uses a credit/token system, tokens are non-refundable and expire according to your specific plan details.
4. Intellectual Property & Content
Your Uploads
You retain all rights to the original images you upload to the Service. You grant Flash Flamingo a limited, worldwide license to process these images solely to provide the Service to you.
AI-Generated Output
Subject to your compliance with these Terms and full payment of applicable fees, Flash Flamingo hereby assigns to you all its rights, title, and interest in and to the Output generated by the Service based on your inputs.
Restrictions
You may not use the Service to generate illegal, infringing, or harmful content. You are responsible for ensuring your use of the Output complies with applicable laws.
5. Acceptable Use
You agree not to:
- • Use the Service for any illegal purpose or to infringe on the intellectual property of others.
- • Attempt to reverse-engineer the AI models or "scrape" the Service.
- • Upload images of individuals without their explicit legal consent.
6. Limitation of Liability
To the maximum extent permitted by Polish law, Flash Flamingo shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Service. The Service is provided "as is" without warranties of any kind regarding the "realism" or "commercial suitability" of the AI-generated images.
7. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Poland. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Warsaw, Poland.
